The sentence passed by the National High Court on January 19, 2023, upholds the contentious-administrative appeal filed by the Spanish Basketball Clubs Association- Asociación de CLubes de Baloncesto (ACB) in relation to the participation of its clubs in the championships organized by the Euroeague Comercial Assets S.A., -ECA- (the Euroleague and the Eurocup) and the threat of FIBA Europe to penalise the clubs that participate in the competitions organised by the ECA with the prohibition of participating in the official competitions organised by FIBA, has been notified.
In particular, the ruling declares the nullity of the CSD resolution by which the agreements of the ACB Assembly ratifying the participation of their clubs in the international championships organized by ECA were rendered null and void.
